Protection of the right to safe water - Pollution of Kali River (East)

Previous scientific studies by Janhit Foundation have identified extremely high pollution loads within the Kali River East (located in Central and Western Uttar Pradesh), due to uncontrolled discharge of untreated industrial and sewage effluent. The river water is also causing contamination of the underlying groundwater aquifers, the only drinking water source available to a large population. Consumption of this contaminated water is having a devastating effect on the health of this population. The Human Right to safe drinking water is being therefore being violated.

In 1999, Janhit Foundation filed a petition with the National Human Rights Commission (N.H.R.C.) in New Delhi demanding they intervene to rectify this situation. After a long struggle, Janhit Foundation succeeded in getting the Uttar Pradesh Government to sanction a project to the value of 880 million rupees to address contamination of the Kali River East. The aim actions of this project were to require industries to install common effluent treatment plants to treat effluent to appropriate standards before discharge to the river, and also the provision of sewage treatment plants all the major towns and cities within the river catchment. Due to a lack of available funds, the Uttar Pradesh Government requested the Ministry of Environment and Forests and the Japan International Cooperation Agency (JICA). However, the Government departments have neglected their duties and failed to keep their promises to deliver this essential work by taking the plea of fund starvation. The contamination of the Kali River (East) continues and the residents within the catchment continue to wait for resolution.

Janhit Foundation is planning to take this case to the Supreme Court of India to continue pressure and ensure the promises made for this project are kept.
